  1. The contract for the Dunwoody Village Parkway is horrible, yet, our Public Works Director Michael Smith is advising you to sign it. The contract says that no one from the city can utter one word about the Village Parkway project unless you get your comment approved IN ADVANCE by the DOT. John, did our legal folks read this? If so, why do we pay them? If not, also, why do we pay them? Why is Smith in favor of silencing you and every rep of our city? You would have to submit your blog comments about the Parkway to the DOT before you can publish them or they can terminate the contract with the city. Yeah, Public Works Director Michael Smith thinks you should sign this contract. What are your thoughts?

  2. Joe, I take for granted that our legal team has reviewed. I searched the web looking to see if it was a standardized term of other DOT contracts and couldn't find a match but that doesn't mean it is not standard language. We will ask.

    Articles, papers, bulletins, data, studies, statistics, interim or final reports, oral transmittals or any other materials reporting the plans, progress, analyses, results, or findings of work conducted under this Agreement shall not be presented publicly or published without prior written approval by the DEPARTMENT.

    FYI, there was a last minute addition to the packet regarding campaign disclosures which should be available on the city version of the agenda and also shown below.

  3. Regarding the language in the DOT contract for the Dunwoody Village Parkway mentioned in the comment above; it is standardized contract language which pertains to only official communication from the City of Dunwoody staff – not elected officials right to free and open speech.

    Over the last five years I think I have missed fewer than the number of fingers on one hand but I was forced to miss on Tuesday therefore I watched both the 6 pm and 7 pm video streams on the City agenda webpage. The city videos should be up on the agenda pages tomorrow.

    All items presented were passed by Council except the ethics complaint against Councilwoman Bonser of uncourteous behavior in an email was dropped / dismissed.

Well, ok, per the city's attorney and manager's interpretation, the term "City of Dunwoody" only means the "Public Information Officer of Dunwoody" - with our City Council and Mayor having no standing as representatives of our city. Interesting, odd, but good to know. I learn new definitions every day.
