  • For financial security and accountability purposes, the City Council converted two Accountants and one Accounts Receivable position to in house city employees.

Request for Five Additional Personnel for the Dunwoody Police Department 

  • Our current Crime Response Team’s name will be changed to reflect the work they do daily conducting traffic enforcement to improve the safety of our roads. The new Crime Response Team (a Sergeant and three Patrol Officer positions) will be able to focus on important crime reduction strategies that can make Dunwoody a safer place for our citizens. Strategies to address areas like drug trafficking, vice crimes, violent crimes, organized retail theft, gang crimes, entering autos, and other areas as needed.  Police Department has also requested a non-sworn, Fleet Maintenance Coordinator to handle everyday vehicle oversight.

  •  Funding for these position has been identified within the ARPA (American Rescue Plan Act) II Fund - one time Federal Funds.

2024 Budget Amendment for Additional Police Personnel and EMS Funding

  • Funding for these positions & expanded EMS services has been identified within the ARPA (American Rescue Plan Act) II Fund - one time Federal Funds.

Dunwoody City Council recertifies as a City of Ethics and strives to live within our stated Vision, Mission & Values everyday.

Last week the Dunwoody City Council passed a resolution readopting ethics principals and pledges for purposes of being re-certified as a City of Ethics and I have been asked to sign the document on Monday when I return to City Hall, therefore I figured this was worth sharing.  It basically says ...

NOW THEREFORE BE IT RESOLVED by the governing authority of the City of Dunwoody, Georgia, that as a group and as individuals, the governing authority hereby readopts and rededicates itself to the following ethics principles and pledges to continue to conduct its affairs accordingly:

* Treat All People Fairly
* Use The Power of Our Position For The Well Being Of Our Constituents

Because we seek public confidence in the City's services and public trust of its decision-makers, our decisions and our work must meet the most demanding ethical standards and demonstrate the highest levels of achievement in following this code.

As the governing body of the City of Dunwoody, we represent as follows:

(1) As representatives of the City of Dunwoody, we will be ethical.

(a) We are trustworthy, acting with the utmost integrity and moral courage.
(b) We are truthful, do what we say we will do, and are dependable.
(c) We will make impartial decisions, free of bribes, unlawful gifts, narrow political interests, and financial and other personal interests that impair the independence of our judgment and actions.
(d) We will be fair, distributing benefits and burdens according to consistent and equitable criteria.
(e) We will extend equal opportunities and due process to all parties in matters under consideration. If we engage in unilateral meetings and discussions, we do so without making voting decisions.

Discussion of Capital Needs and Potential G.O. Bond Call

I hope everyone had a relaxing Spring break from school & enjoyed the holidays with family whereby you are now ready to return to the normalcy of April & May, with everything that it brings (Lemonade Days, Food Trucks, better weather & end of the school year). My family drove to Chicago to see our parents who are getting up in age therefore my city blogging / informational duties fell behind a bit.

On March 22 & 23, the City Council met with representatives of Canton, GA and then regrouped in Dahlonega, GA for internal discussions on numerous topics. Here are the official minutes from the retreat that will be approved Monday and let me point out that the last several pages of that document outline the action items for staff & council.  All of the documents used in the retreat are listed below but let me highlight a few.  

The Dunwoody's Own Direction document starts us off with our goals from the Comprehensive Plan and how we have been working towards them this year vs last years accomplishments.  We discussed changing city demographics, improved diversity opportunities, our work on Dunwoody Village improvements, and Pedestrian Safety.

We discussed Public Safety with Chief Grogan, the push for EMS changes and police staffing needs that we believe will be detailed in the upcoming Berry-Dunn Report.  

We discussed Communications, specifically improved public engagement & feedback on citizen Code Enforcement & See Click Fix issues and then we discussed how to improve City Contracting of large public works projects for better results.  

The 15 million dollars of Federal Funding / American Rescue Plan was discussed, we went over the expenditures.  Council requested assurances that expenditures will be made within the Federal timelines and on appropriate allowed subjects.

Bond Referendum - The last big item we discussed was the funding of Capital Projects and whether a Bond referendum is appropriate for this coming November.  A citizen committee was convened to discuss this topic and made a list, the City Council may finalize the list of desires and call the question to hold a referendum, but it is the citizens who will need to approve or deny the call to raise taxes for capital improvements.  The capital discussions have routinely been around the improvement of Parks, Transportation / Street Intersections, and multi-use Paths.  

I am against the City's construction of 12 ft wide concrete paths in front of single family homes and I prefer three referendum questions so that citizens (like me) could vote for some projects and possibly against others but it appears that may not be the plan?  Ideas on path locations are not set in stone and at the retreat some path ideas being pushed previously were removed (probably because of the backlash) and new ones were being added without vetting to to public nor having any engineering designs to really discuss the proposals.  The Chesnut community has been vocal for needed improvements on North Peachtree between Dunwoody Village Apartments and Peachtree / Brook Run, therefore this idea was just added for a new trail and as much as I want improved infrastructure for safety, I still believe a 12 ft concrete path is overkill.   The other new addition calls out Dunwoody Village path improvements but I believe it is really a 12 ft concrete trail along Chamblee Dunwoody from Womack to the new Austin Park.  Neither of these projects have been engineered, vetted, or even discussed with the nearby residents

I raised concerns on the one question idea, I raised the fact that we just received 7 million dollars from the sale of land on Shallowford that was originally intended for parks; therefore the City should plan for spending that money prior asking the citizens for more.  Finally I still have long term budgetary concerns based on the rising cost of government operations (Public Safety in particular) and general maintenance vs the possibility of an unstable business tax base when we have several large office buildings vacant.   The last item on Monday nights agenda will initiate a discussion for a $55 million bond referendum whereby a single question will be brought in front of the citizens.

Update on Edge City 2.0 Project

The City of Dunwoody would like to develop a new vision for the future redevelopment of the Perimeter Dunwoody market that is shared by elected officials, the DeKalb board of the Perimeter CID, major property owners, governmental partners, and community stakeholders.

The City of Dunwoody and ARC anticipate the following outcomes from the study to be:

  •  Provide an updated vision that reflects current conditions and 20-year build out.
  •  Develop transportation investments that provide for safe movement of pedestrians, bicycles, and transit in, through and around the Perimeter LCI area.
  •  Develop case studies of comparable edge cities that provide real world examples of what the district could look like under chosen growth scenario.
  •  Develop a 3D GIS model of the growth scenario that is compatible with the City of Dunwoody’s ESRI ArcGIS based System, and can be revised by city staff.
  •  Develop a Fiscal Impact Model for the city, county and school system that can be adjusted in future years and future economic conditions.

City of Dunwoody passes resolution urging Cities to get a seat at the table on the new DeKalb Ethics Board.


RESOLUTION URGING DEKALB COUNTY AND THE GENERAL ASSEMBLY TO PASS THE LIMITED CHANGES TO THE DEKALB ETHICS ORDINANCE CODIFIED AT ARTICLE 22A OF THE CHARTER OF DEKALB COUNTY REQUIRED BY THE DECISION OF THE GEORGIA SUPREME COURT IN DELAY V. SUTTON

WHEREAS,  the City of Dunwoody is authorized and empowered by its Charter to administer and regulate the ethical conduct of its elected and appointed officers; and

WHEREAS,  the City of Dunwoody has been recognized by the Georgia Municipal Association as a City of Ethics since 2009; and

WHEREAS,  the City of Dunwoody has established its own policies and ordinances to review and evaluate its officials’ conduct as open, transparent, and lawful under the Charter of the City and the Constitutions of the State of Georgia and of the United States; and

WHEREAS,  DeKalb County Voters overwhelmingly approved a referendum in 2015 amending the Charter of DeKalb County and establishing an Ethics Code in the County’s Charter; and

WHEREAS,  the Voters’ expression at the ballot box sent a very loud message to their County and State elected officials that they demand a strong, independent, and transparent ethics Board to oversee County elected and appointed officials and employees; and

WHEREAS,  the Supreme Court of Georgia, in Delay v. Sutton, 304 Ga. 338 (2018), invalidated and held unconstitutional the creation of the DeKalb Ethics Board on the single issue that appointments were made to the Ethics Board that were not confirmed or approved by elected officials; and

WHEREAS,  the invalidation of the Ethics Board on the single Court ruling now calls into question the entirety of the Ethics Ordinance, especially including the appointment, function and role of the County Ethics Officer; and

WHEREAS,  with the growing number of existing and planned Cities in DeKalb County, the wishes and demands of citizens in incorporated areas for ethical and transparent government are of increasing importance in how the County manages its governance and operation; and

WHEREAS,  the Elected Officials of DeKalb Cities speak for their constituents and deserve a voice, role, and function in the re-establishment and efficacy of a reconstituted DeKalb Ethics Board; and

WHEREAS,  the delay caused by extraneous issues infiltrating the discussion and resolution of the single issue upon which the Georgia Supreme Court ruled is detrimental to the standing, credibility, and future of DeKalb County and her incorporated areas;

NOW THEREFORE, the Mayor and City Council of the City of Dunwoody, in an open and public meeting, RESOLVE AND STATE the Will of the Council as follows:

1.         The General Assembly, or the Board of Commissioners, as appropriate, should address and remedy the single issue they created that led to the Ethics Board being declared unconstitutional by the Georgia Supreme Court and that issue only.

2.         It is of paramount importance that the General Assembly and the Board of Commissioners take this issue seriously, that they hear the import of the voices of the electorate of DeKalb County who demand ethical and transparent representation (as expressed in the referendum in 2015 and in their rejection of the amendments proposed in SB 7 of the 2019 Session of the General Assembly), and come to a resolution of this problem as soon as practicable.

3.         DeKalb Cities need to be granted an effective and appropriate voice through their elected officials in the appointment and conduct of the Ethics Board, to include nomination(s) made to the Board of Ethics by a majority vote of the Mayors of the Cities in DeKalb County, submitted to the Board of Commissioners for confirmation, for 2 members of the Ethics Board, one of which should be a member of the State Bar of Georgia.

4.         The City of Dunwoody sees value in the input of various community groups in determining the composition of the Ethics Board and urges the General Assembly and the Board of Commissioners to enact a lawful process by which such groups can continue to have a role and mechanism to inform and suggest membership to the Board of Ethics.

5.         The City Council designates the Mayor, or her designee, as the official with authority to negotiate on behalf of the City of Dunwoody to give effect to this Resolution and to bring a report to the Council as necessary on the progress of the response to these demands.

6.         The City Council adopts as its factual findings in support of this Resolution the language included in each “Whereas” paragraph above.

            SO RESOLVED, this 27th day of January, 2020.

City of Dunwoody asks "What is a Conflict of Interest?" - get three opinions.

During the August 22nd City Council meeting the City of Dunwoody released two separate city memorandums documenting legal opinions related to conflicts of interest of elected or appointed officials. As the Dunwoody Homeowners Association also hired an attorney to review the matter they also rendered a third legal opinion which I have included here in chronological order as it is also referenced in the City's latest reply.

The first memorandum, dated June 6, 2016, is related to "Conflict of interests of officials and relationships with outsides agencies," and was submitted by City Attorneys Cecil G. McLendon and Leonid Felgin. This legal opinion was given to the City Council and City Boards and it is my personal opinion that it appears to be written with an extreme amount of caution in order to protect the city from even the appearance of undue influence.

The second memorandum, dated August 12, 2016, is related to "Conflict of Interest Relating to Dunwoody Homeowners Association Members Serving on City of Dunwoody Board, Commissions and Council," and was submitted by Seth G. Weissman. of Weissman Nowack Curry & Wilco Attorneys at Law representing the Dunwoody Homeowners Association.

The third memorandum, dated August 19, 2016, is related to "Questions from City of Dunwoody re conflicts of interest," and was submitted by Abbott S. Hayes, Jr. of Hulsey, Oliver & Mahar, LLP who the Dunwoody City Manager recommended as an outside council to have another look at the subject.  Besides possible conflicts of interest, this memo also explores the question to see if the privilege of  Executive Session was abused or if the calling of this closed door session was improper.   This attorney believes the use of executive session was proper in this case.

I am not an attorney but I know that legal opinions are just that, opinions.   Be they right or be they wrong, they are the opinions of legal training that I do not have, therefore I (as well as Council)  may need to someday weigh the various opinions against levels of acceptable risk to make formal policy.   Until that vote of Council happens, I believe there is no legal or ethical policy that I or anyone else related to the City is forced to follow on the subject therefore I will let my personal conscience be my guide as to what I consider an appropriate action for myself and I will need to live with my actions and/or suffer the consequences.

As such, I plan to attend as many community meetings that my busy calendar can handle to be well informed on all items that may come in front of me, including the next monthly Dunwoody Homeowners Association Meeting on September 11th and then on Monday September 12th the Dunwoody City Council meeting where I believe the Mayor will be inviting outside Dunwoody Council Mr. Abbott Hayes to publicly brief the legal advice and opinions presented in the August 19th memo written on the subject.
