In other news, I have been traveling for work and have had no access to City Emails for over a week but I hope to get that back on Monday.  If you have reached out to me via the City email, I hope to reply soon.  

Wednesday & Thursday of this week, I get the privledge of attending the City of Dunwoody Council "Retreat" where we sit in a room for two days discussing important items like funding / spending policy, project strategy, service delivery with contracts that need to be renewed, Police, EMS and the Turf Field at PCMS.  Not 100% on the agenda as I haven't seen it (if it was sent via email) and it is not published on line for the public either.  I was given a 'save the date' message a few months ago which showed the location of this two day public meeting (in which I am forced to burn work vacation days for), as it will be at the Glen-Ella Springs Inn & Restaurant, 1789 Bear Gap Rd, Clarkesville, GA 30523, USA.  I do not believe this meeting will be live streamed for the internet to view therefore if you would like to attend, please drive the two hours to join us.  News reporters, you may want to get a room so you can watch us make smores over the firepit in the evening and then be onsite for the early morning conversations which might be interesting (in the hopes that you aren't there yet).   I will post more info on the "retreat" as it becomes available.

I noticed on social media that the Mayor is holding a State of the City address in the coming weeks with the business community, but don't know more about it except for what I read there & here

Here is a Powerpoint Presentation highlighting what is in the 2025 budget and how we are funding it. 

 The 2025 general fund budget is pretty bare-bones except for cost increases (salary, health insurance, contract escalations, & fully funding the nine police positions we added in 24).  Many of the additional police personnel expenses in 2025 are being paid with ARPA (Federal) Funds that will not be available in the future and with city expenses escalating faster than revenue, I understand that the city is facing an issue in the coming years in order to maintain the same level of service; especially as all city service contracts will be renegotiated with expected large increases.  This is an issue that I am guessing will be discussed in detail on Monday morning.

Capital funds are special revenue streams that typically can not be used for General Fund (operating) expenses like salaries, so these funds can not be used for those expenses but instead can be used for things and construction.  On the 2025 Capital funds front, we estimate $20 Million will be spent, with street paving & intersection improvements being a big chunk of those funds.  Besides streets, there is $3 Million for path construction, $1.8 Million for a new bridge over 285 at Chamblee Dunwoody, $1.7 Million for new Police Vehicles / Equipment, $1.3 Million for a new Brook Run Maintenance Building, $1 Million for the Dunwoody Nature Center Expansion, $1 Million for the new turf at Peachtree Middle School where the city already has a long term lease, $700K for a new SWAT Storage Building as well as another $1.7 Million for contingency and/or possible other additions like Sand Volleyball courts that were programed for the back of Brook Run near Tree Top Quest.

There were several special called meetings that took place in June while I was away on vacation that were called to have preliminary hearings on the setting the Millage Tax Rate for the City.   The tax rate is not changing as we are already at the maximum allowed per the charter but there was a 3% increase in the valuations therefore we need to advertise this as a tax increase.  Reminder that homeowners with an Homestead exemption and freeze in place, will not see a City of Dunwoody millage tax increase over last year.  Besides the millage rate item, the first special called meeting the evening of June 26th, had a few other items on the agenda I wanted to recognize.

Minutes from May 28 - huge error on Vermack / DHS Lights vote tally *

Updating Permitting Fee Schedule to Comply with State Law Changes

* On May 28th, there were only five members of Council in attendance as Mayor Detusch and Joe Seconder were away. The approval of 18, 12 foot high lights was discussed whereby Councilmember Price wanted to defer approval until others were in the room and I stated I was against the measure completely.  The motion to approve was made by Councilmember Harris and I believe seconded by Councilmember Lautenbacher prior to Councilmember Price's formal request to defer therefore the City Attorney stated we should move forward with the motion on the table and not defer.  The vote went forward with a 3 to 2 vote (Harris, Lambert & Lautenbacher in favor with Heneghan & Price against) making this the first city council item in 15 years to pass with less than the four members needed for majority.  With the 3 to 2 vote there was a quick discussion on weather the item passed or failed and with the reading of the Charter it was confirmed that it passed.  The minutes up for approval at this mistakenly shows a 5 to 0 vote for approval, it fails to identify the discussion / motion made by Councilmember Price nor any notes as to the discussions / decisions of the City Attorney nor my questioning as to the funding for this project.  If this item was deferred as normal course in order to allow the full Council to vote, who knows it might have failed, been modified or it might have passed with me being the lone no vote. Guess we will never know?

To me, the approved lighting of the "Vermack Trail" (located only in front of Dunwoody High School and not planned to go anywhere else) with 18 lights (identical to what is now on Winters Chapel) is excessive in both the amount of lighting and monthly cost and it also goes against the desires of the neighbors directly across the street from the school.  It was also unclear to me as to who would be picking up this expense (be it General Fund or DeKalb County School System) for pedestrian lighting as I have looked at the tax records and don't see a street light fee being paid by either the school, or the residents of Vermack.  As these are "12 foot tall" pedestrian lights, they are not street lights and therefore not a fee that we can pass on to the adjoining property owners.  I believe this approval also sets a bad precedent for all future trail lighting, including all those planed on Winters Chapel, Peeler, Chamblee Dunwoody and maybe someday to a street in front of, or across from your home.

First Read: Review and Consideration of a Text Amendment to Update the Clean Indoor Air Regulations, Chapter 24

I am not a smoker but I have attended "late night business meetings" in an establishment that focused on Bourbon and Cigars. The place of business I visited had a negative pressure air filtration system whereby my clothes didn't smell of smoke when I left.  I believe this proposed ordinance brought to us from the American Heart Association and placed on the agenda by staff or council is an overstep of regulations and I am unsure what we are fixing.  I would like to know the complete impact of the proposal prior to voting on it especially when it may limit a niche business model that could bring a successful establishment to our city.  I understand the intent of protecting all employees from second-hand smoke but when the establishment (or private club) can protect employees an exception needs to be explored.  I will be asking staff to review Gwinnett, Houston and other jurisdictions looking for best practices allowing exceptions.  A cigar bar exception could include the following ...

“Cigar Bar means an establishment operated by a holder of an On Premise Beer and Wine
Permit or other Alcohol Beverage Licensing Permit that:
1. Does not sell food;
2. In addition to selling beer and wine, annually receives 15 percent or more of
its gross revenue from the sale of cigars, and tobacco-related products, except from the sale of
cigarettes. A cigar bar shall not discount alcohol if sold in combination with
cigars or other tobacco products and tobacco-related products;
3. Has a walk-in humidor on the premises;
4. Has a high capacity, negative pressure air cleaning ventilation system, located in such a manner to control second hand smoke exposure to non-smokers.
5. Only permits the smoking of cigars, and does not permit the smoking of cigarettes; and
6. Does not include any establishment which is primarily a bar or restaurant and
which undertakes to make retail offerings of tobacco products as a means of
circumventing the purposes of this article.”

On November 7th, the Citizens of Dunwoody voted down a bond referendum for Parks & Paths development and on November 8th an RFP was released for the Winters Chapel Path design which mandates that the path will be 12 feet wide, even in front of the single family residential properties.  This item is now on the agenda for discussion.

Description: Winter Chapel Road Path Phase II. The project consists of a 12-foot shared-use path (SUP) along the west side only of Winters Chapel Road between Charmant Place and Peeler Road in the cities of Dunwoody and Peachtree Corners. In addition to the shared-use path, the project will add lighting and street trees along the corridor. The project connects residential areas on the north end of the project to a MARTA bus route and commercial node at the south end of the project.
