First Read: Review and Consideration of a Text Amendment to Update the Clean Indoor Air Regulations, Chapter 24

I am not a smoker but I have attended "late night business meetings" in an establishment that focused on Bourbon and Cigars. The place of business I visited had a negative pressure air filtration system whereby my clothes didn't smell of smoke when I left.  I believe this proposed ordinance brought to us from the American Heart Association and placed on the agenda by staff or council is an overstep of regulations and I am unsure what we are fixing.  I would like to know the complete impact of the proposal prior to voting on it especially when it may limit a niche business model that could bring a successful establishment to our city.  I understand the intent of protecting all employees from second-hand smoke but when the establishment (or private club) can protect employees an exception needs to be explored.  I will be asking staff to review Gwinnett, Houston and other jurisdictions looking for best practices allowing exceptions.  A cigar bar exception could include the following ...

“Cigar Bar means an establishment operated by a holder of an On Premise Beer and Wine
Permit or other Alcohol Beverage Licensing Permit that:
1. Does not sell food;
2. In addition to selling beer and wine, annually receives 15 percent or more of
its gross revenue from the sale of cigars, and tobacco-related products, except from the sale of
cigarettes. A cigar bar shall not discount alcohol if sold in combination with
cigars or other tobacco products and tobacco-related products;
3. Has a walk-in humidor on the premises;
4. Has a high capacity, negative pressure air cleaning ventilation system, located in such a manner to control second hand smoke exposure to non-smokers.
5. Only permits the smoking of cigars, and does not permit the smoking of cigarettes; and
6. Does not include any establishment which is primarily a bar or restaurant and
which undertakes to make retail offerings of tobacco products as a means of
circumventing the purposes of this article.”

On November 7th, the Citizens of Dunwoody voted down a bond referendum for Parks & Paths development and on November 8th an RFP was released for the Winters Chapel Path design which mandates that the path will be 12 feet wide, even in front of the single family residential properties.  This item is now on the agenda for discussion.

Description: Winter Chapel Road Path Phase II. The project consists of a 12-foot shared-use path (SUP) along the west side only of Winters Chapel Road between Charmant Place and Peeler Road in the cities of Dunwoody and Peachtree Corners. In addition to the shared-use path, the project will add lighting and street trees along the corridor. The project connects residential areas on the north end of the project to a MARTA bus route and commercial node at the south end of the project.

Discussion of the Athletic Association Manual 

The proposed Athletic Association Manual is being presented to the full City Council (and the public) for the first time on Tuesday for discussion purposes only. I was not on the developing committee, therefore I will need to thoroughly review the pros and cons of the proposed changes and see what benefits it will bring.  As a City we need to review the costs related to using our park facilities, set up a sinking fund to slowly save for the replacement of the turf fields, the financial charges to the organizations using the facilities, the availability of the facilities to organizations or groups that are not part of a use agreement (like Dunwoody High School teams), the allowance of rentals to outside organizations by the various Athletic Associations, the historical agreements that may have been in place for years and how these proposed changes will affect the established users.  One of the possible changes being proposed is allowing the Baseball Fields and Soccer Fields to a wider more diverse group of users who are not currently using the fields.  At the moment those uses are not organized, as the open time on some of the fields does not envision a wider use than what is already there.

Council has received a number of inquiries from Dunwoody Senior Baseball (and the residents who participate in this activity) asking for clarification of the modifications and opposing any change in the current financial agreement between that organization and the city, therefore I am guessing at the Tuesday meeting we will be hearing from that organization and possibly others.

In Feb of 2020, the internal auditor for the City provided a review of the Dunwoody Senior Baseball program which I believe is driving some of these proposed changes especially as it relates to the current use agreement.

Bev Wingate, the First Lady of "Dunwoody Yes" and Consummate Volunteer is honored with a proclamation.

PROCLAMATION

WHEREAS, Beverly Jean Wingate (Bev) is a determined, rational, intellectual, energized woman with a clever wit and a quick sense of humor, who is faithfully dedicated to her family, country and city; and

WHEREAS, growing up on a farm in Champaign Illinois, Bev learned the definition of perseverance and hard work. She was active in the 4-H Club, and Future Homemakers of America; she was taught to be involved with the local community. She ran track, was the feature editor for the school’s newspaper, served on student council, and was a regular on the campus radio station WKID; and

WHEREAS, on August 1952 (just before her 18th birthday); she was hired by Illinois Bell Telephone to be an operator in their call center in the Champaign area. Bev retired in the fall of 1961 after 6 promotions, and almost 10 years of service, to marry Walter R. Anderson in November 1961, and begin a family. Son Walter was born in May 1966. She was divorced in 1971, and married Ron “Windy” Wingate in November 1972. She was married to Windy (46 years) until his passing in November 2018. She is a fantastic Gamma to son Walter’s only child Courtney, and mother-in-law to Cheryl; and 

WHEREAS, in July of 1960 Bev was one of four women to supervise the call center for the Republican National Convention in Chicago. Bev honed her political skills here as the center was just off the convention floor for use by the delegates, press, and the public; and

WHEREAS, Dunwoody appreciates Bev for her 40+years of support, service and leadership to: Dunwoody Newcomers Club, Dunwoody Woman’s Club, Dunwoody Preservation Trust, Spruill Center Guild, Stage Door Players, Dunwoody Nature Center, Dunwoody Veterans Day, Memorial Day and 911 Memorial Events, 4th of July Parade 2007 Grand Marshall with her husband Windy, DeKalb County Domestic Violence Task Force, DeKalb County Veterans Advisory Board, and Dunwoody United Methodist Church, and

WHEREAS, outside of the political and volunteer areas, Bev’s hobbies are: cooking, macramé, oil painting, learning to play musical instruments including the ukulele, organ, and recently learning how to play the piano, reading, crossword puzzles, and lover of animals, particularly German Shepherds, and is now Gamma to a Great Dane. Bev was a licensed small plane pilot in the 70s and 80s, and at one time held a real estate license. She currently drives around Dunwoody in style as the coolest Gamma ever in her black, 1997 Trans Am with T-top; and

WHEREAS, Bev was an integral member of the Founding Committee for the Incorporation of the City of Dunwoody, where her insight, professional expertise, and historical knowledge of Dunwoody contributed to the efforts of the committee. Bev helped guide the resolution for the incorporation of the City of Dunwoody in 2008 and continued her service on various city committees. Bev calls herself a “fire fighter”; she puts out fires with her wealth of knowledge before misinformation burns out of control; and

NOW, THEREFORE I, Lynn Deutsch, Mayor of Dunwoody, Georgia do hereby proclaim September 9, 2020, as Bev Wingate Day in the City of Dunwoody in honor of her service, dedication, and commitment to the Citizens of Dunwoody Community. The unofficial “Mother of Dunwoody”.IN

Dunwoody Mayor Denny Shortal was honored with a proclamation at volunteer appreciation dinner.


PROCLAMATION


WHEREAS, Denny Shortal has been an involved member of the Dunwoody community for 36 years, including volunteer Athletic Director for eight years at St. Jude the Apostle Catholic School, a community pitching coach at St. Pius High School, has participated in athletic activities at the Shepherd Center, served as a member and current president of the Marine Corps Coordinating Council of Georgia, and as a faithful volunteer building homes for Habitat for Humanity with the Knights of Columbus; and 

WHEREAS, Denny Shortal served an integral part of the development of the City of Dunwoody. He was a founding board member and co-chairman of Citizens for Dunwoody, Inc., leading the organization and providing strategic direction that ultimately culminated in the community’s overwhelming approval of the incorporation of the City of Dunwoody; and
WHEREAS, Denny Shortal was elected during Dunwoody’s first municipal election on September 16, 2008, and served with distinction as one of the first Councilors of the City of Dunwoody until January 2015, when he was elected as Mayor. During his tenure on council he spearheaded initiatives that have provided a strong foundation for the City of Dunwoody by balancing competing projects and priorities while maintaining the tax millage at 2.74 mills; and  
WHEREAS, as Mayor, Denny Shortal is known for staying true to his principles,  working through critical issues by careful consideration of all angles and relevant information, he is also  known for his quick wit and astuteness when the occasion warrants, an "Oorah!" for his beloved U.S. Marine Corps; and
WHEREAS, in addition to his exemplary performance as  Mayor of the City of Dunwoody, Denny Shortal has demonstrated his commitment to the community through his influential membership in civic organizations in Dunwoody and across metropolitan Atlanta; and 
WHEREAS, after leading the City through incorporation and laying a strong foundation for the future, Denny Shortal’s decision not to seek re-election will allow him the opportunity to spend more time traveling and enjoying life with his family.  In all these pursuits, the City anticipates that Denny Shortal’s devotion of his time, talents, and energy will continue to be to the betterment of his community; now
NOW THEREFORE, I, Lynn Deutsch, Mayor Pro Tempore of the City of Dunwoody, Georgia, do hereby recognize and commend Denny Shortal for his selfless service to the City of Dunwoody.  I hereby proclaim November 14, 2019 as
