There were several special called meetings that took place in June while I was away on vacation that were called to have preliminary hearings on the setting the Millage Tax Rate for the City.   The tax rate is not changing as we are already at the maximum allowed per the charter but there was a 3% increase in the valuations therefore we need to advertise this as a tax increase.  Reminder that homeowners with an Homestead exemption and freeze in place, will not see a City of Dunwoody millage tax increase over last year.  Besides the millage rate item, the first special called meeting the evening of June 26th, had a few other items on the agenda I wanted to recognize.

Happy New Year and I hope everyone's holiday season was joyous spending time with those you love, staying warm and dry as the days are now getting longer.  This meeting starting at 6 pm looks short because many of us (and staff) may have other plans for later that evening but that doesn't mean important things aren't being done.  First we are adding another police officer to our ranks and we are getting closer to being fully staffed, welcome Officer Umana.  

Read the retreat document, look at what we accomplished in 2022 but also note what we have put off or kicked down the road.  In 2022 we put off a call for a General Obligation Bond for Capital Projects and a Special Tax District for Parks & Police for operational expenses.  I believe both may be back on the agenda in the coming months, to be possibly be added to the ballot in November of 2023?

Immediately below I am re-posting document links from the May 23, 2022 meeting where city finances and possible bonds were discussed.

City of Dunwoody Millage and Bond Rate Discussion and comparable rates in DeKalb the possible list of projects  -  Bond FAQ  -  Steps to Bond Referendum

Remember how just a few months ago I said our 2023 budget looked like an ugly baby?  We need to determine the capital desires of the community and the correlating operational expenses (more parks/more maintenance expenses) vs (fully staffed Police Department at appropriate salary / benefit level is an expense we can not compromise on) with inflationary pressures on a tax digest that has limited escalating raises. Because Dunwoody was one of the first cities to break away from a County to incorporate, we were given very tight financial constraints that other newer cities do not have.   14 years after incorporation we have rising inflation, rising costs but also have a  home valuation freeze, a 1 mil tax reduction that was a replacement for a credit that was given back, but the reduction stuck, and we are now at our maximum ad valorem tax rate on real property of 3.04 which by my reading of the Charter would need the approval of the Citizens to increase that general tax rate.  Tough decisions & discussions on finance are coming.

All of these conversations will be taking place in the future as I am always concerned of the viability of our many office towers as leases come up for renewal and the pressures to have employees work from home seems to grow.  A vibrant office district in Perimeter Center is what we all desire as it is an economic engine that also fills the restaurants, the stores, raises demands on housing and also adds to the tax base which lowers the burden on the residents who live here.  We need a vibrant mix and the Mayor and City Council have been working on that goal since day one of incorporation.

Please read the City Managers Report as it is eye-opening in many ways, the City does so much behind the scenes and I have nothing but admiration for the staff and police officers who make this City function everyday.  You may have heard about the shooting between two knuckleheads at the mall, I don't know more than anyone else, but I do know Dunwoody PD showed up in force, handled the situation and brought the person responsible into custody.  Please be aware of your surroundings but don't let knuckleheads make you fearful of living your life, Perimeter Mall and Dunwoody is still a safe place to be.

City Council had a special called meeting on a day I was out of town to talk to our State Legislators, I'm sorry I missed as the minutes tell me topics but not specifics.  If I'm lucky I hope to attend a few DeKalb Delegation meetings down at the Capital as I think they take place on Mondays at Noon and I can't think of a more entertaining lunch.

Monday is a first read (just discussion / not approval) of an update to our Sign Ordinance which looks like minor tweaks and administrative fixes.  I have a couple of days to read & evaluate the proposed changes, if there are issues with the proposed changes please let me (us) know as I value your input.

There is a discussion scheduled to talk about the pedestrian improvements in Dunwoody Village as I (and a few others) pushed back on the proposed design as there is a lot of money being planned to be spent whereby there wouldn't any vehicle throughput improvements through the intersections of Chamblee Dunwoody & Mt. Vernon.   Staff has looked at modifying the proposal and did not find a way to improve traffic flow with out negatively impacting (obtaining) business properties.  Staff also received an 8 million dollar estimate to bury electrical lines as part of the project and at the moment we do not have the funds for that idea to move forward. It looks like the original plans without any traffic improvements, is back on the table.

The proposed improvements presented in March 2022 consist of a cycle track and wider sidewalks on both sides of Chamblee Dunwoody Road from Womack Road to Roberts Drive. The cycle track will be separated from the vehicle travel lanes and raised to the level of the sidewalk. A landscape buffer with street trees and lighting will separate the cycle track from the sidewalk. In areas, such as in front of the farmhouse, where the public right of way is not as wide, the buffer width will be reduced and landscaped without street trees. The proposed design for the roadway generally maintains the lane configurations as they currently exist with the exception of removing one of the southbound through-lanes south of Mount Vernon Road. In areas north of Mount Vernon Road where a center turn lane is not needed, the turn lane would be converted to a landscaped median with the goal of adding greenery, calming traffic and creating safer pedestrian crossings.

The 2023 paving plan is moving forward (as the streets have been planned and scheduled for repaving in a past 3 - 5 year plan) and we are spending close to 3 million dollars to pave 15 lane miles of streets.  Looking at the map, we are doing well to pave the worst first and it won't be long before every public street in Dunwoody would have been paved.

Finally we have a contract to consider on MARTA Bus Shelter advertising.  I like shelters where needed, I dislike the advertising & signage that is sometimes not appropriate for single family neighborhoods & near schools.  Would you believe that I raised this very topic ten years ago, argued that we were not under contract with MARTA nor the Advertising company, converted several signed shelters to non-signed; while agreeing to allow a few advertising shelters in place in commercial zones where appropriate.   We now have all contracts prior in place expiring and they are up for renegotiation.  What should we do?

The Village to host First Dunwoody Green Eggs & Kegs Festival 2022 - Saturday April 23rd, benefiting Juvenile Diabetes Research Foundation

A Community Gathering in Support of the Juvenile Diabetes Research Foundation.  The event tickets sales end April 22nd so please donate to a great cause & have a wonderful time as there will be unlimited food tastings and beverage is included.

On Saturday, April 23, The Village at 5521 Chamblee Dunwoody Road will present Green Eggs & Kegs 2022, showcasing local hospitality owners, live music, beer, and spirits, as well as street performers. This ticketed event will be hosted throughout the Dunwoody Village courtyard and parking lot in support of the Juvenile Diabetes Research Foundation (JDRF).

Did you know that Taggart's Driving School in Dunwoody Village offers free Driver's Education with a State Scholarship available to all?


At least two, if not all three of my teenage sons took advantage Georgia Driver's Education Grant for free driving school at Taggert's Driving School in Dunwoody Village and here is how to go about doing it.

Teenagers can not get a drivers license until their 16th birthday in Georgia, and not until the proposed new driver has been driving under an instructional permit for one year before that.  A right of passage for many 15 year olds is to go to the DMV on or soon after your birthday to get your permit.  There is a vision test and a basic written examination to pass plus there will be numerous id cards, utility bills and school documents to bring to prove age, residency and school attendance, so be prepared.

After the permit is obtained, the permit number is the key to being able to register for the Georgia Driver's Education Grant and you would want to do that as soon as the permit is obtained.  The application criteria is needs based but if there are no needs applicants the grant is given out on a first come first served criteria.  In my sons case, we were selected for the educational grant several months after completing the application which is perfect as we used those first several months driving around empty school parking lots and cemeteries where he couldn't kill anyone but his father.

After filling out the application, and you are eventually chosen for the grant; the State notifies you with a redemption code and you register with Taggarts with that number and the class cost for the 30 hours of instruction and 6 hours of driving are waived (a $535 value).

Once driver's ed is completed, there is also a requirement to provide 40 hours of supervised driving with parent or guardian in order to get the license and then for good measure my Dad forced me to change the oil in the car, know how to jump the battery and change a tire.

Good luck with your young driver as it is truly a memorable right of passage for our youth and a for some of us older folks, it can also be a traumatic parental period as well.  

FYI, there are no break pedals on the passenger side.   Enjoy.

Dunwoody Village rezoning proposal comes back to Planning Commission on Tuesday the 13th and it appears to be topic of discussion at Sunday Night's DHA Meeting.

On Tuesday July 13th at 6 pm, the Dunwoody Planning Commission will be hearing a rezoning case for the segment of the Dunwoody Village that was not rezoned last year.  Council pulled these properties from a larger rezoning after the City and the individual council members were each sued in our individual capacity by the owner.  The City and the owners have been negotiating for the rezoning to continue and it appears that that those two parties have come to an agreement as outlined in this matter but are the terms of proposed future development in the best interest of all involved? 

The Planning Commission will hold hearings on Tuesday, the Dunwoody Homeowners Association will be discussing this on Sunday Night live at the City Annex Building 4470 N Shallowford at 7:30 pm and it is usually also available at the same time streaming on Facebook but as I know this matter will come in front of City Council once again, therefore I (and the rest of Council) will be in listening mode until after the matter is officially brought to Council and formal public City Council hearings are held.  

The same restrictions of making judgements or statements about the rezoning are also in place for Planning Commission Members to not discuss the matter until which time their body holds hearings.

On November 30, 2020, the City Council adopted the new zoning code for the Dunwoody Village. As part of the code overhaul, the City comprehensively rezoned properties in the Dunwoody Village area to four new Dunwoody Village zoning districts. The two subject parcels were initially part of that process; however, the City Council removed both after objections by the property owners. This rezoning case will complete the Dunwoody Village comprehensive zoning project and implement the zoning component of the Dunwoody Village Master Plan. 

The parcel at 5500 Chamblee Dunwoody Rd. is currently zoned C-1 and is developed with the Shops of Dunwoody shopping center, including businesses such as Nai Thai Cuisine, Dunwoody Tavern, and Taqueria Los Hermanos. The parcel at 1244 is zoned C-1 and is developed with a small two-story commercial building and the Sunshine Carwash facility. Both lots front towards the Dunwoody Village district and are separated by an approximately 150- to 200-foot buffer towards a single-family residential neighborhood to the west.

The main issue of contention was the 130-foot undisturbed buffer plus 20-foot required transition yard along the western property line and adjacent to the Dunwoody West subdivision. The property owners contested that the buffer would amount to a taking. At the time of development in the 1970s, the developer negotiated a 150-foot buffer with the neighbors to the West. This private agreement expired since. The staff also conducted an extensive search for zoning conditions. The files transferred by DeKalb County at the time of the City’s incorporation appear incomplete, and additional open records requests to the County did not provide additional documents. Based on an initial review, the staff cannot find evidence of any zoning conditions requiring a 150-foot buffer.

Since then, the staff has continued negotiations with the property owners of the two subject parcels to complete the Dunwoody Village district-wide zoning project. The proposed agreement rezones the subject properties to the DV-4 (Village Center) district. Along the western property line of the two parcels, a 35-foot buffer adjacent to the property line is followed by a 115-foot required open space.

Under the initial draft regulations, the parcel at 1244 Dunwoody Village Parkway was zoned DV-1 (Village Commercial), while 5500 Chamblee Dunwoody Road was split-zoned along a future north-south street with the part fronting Chamblee Dunwoody Road zoned DV-4 (Village Center) and the part to the rear zoned DV-1 (Village Commercial). Under the current proposal, the entirety would be zoned DV-4. The DV-4 district is intended as the core of the Dunwoody Village area and provides a mix of uses, centralized open spaces, and highly walkable development patterns at the highest intensity level of the four Dunwoody Village districts. When compared with the DV-1 district, the permitted uses are fairly similar, while the DV-4 district allows an additional story and higher impervious cover (see below table for comparison).

The heart of the agreement is to shift future development density from the western part of the properties, adjacent to the neighborhood, towards the center of the Dunwoody Village district. The property owner agrees not to construct any buildings within 150 feet of the neighborhood, while being granted the additional development potential that comes with the DV-4 zoning. While there are no current development plans, the staff believes that this agreement allows for sufficient development rights to achieve the goals of the Dunwoody Village Master Plan, while reducing impacts on the residential neighborhood.The combined 35-foot undisturbed buffer and 115-foot open space exceeds the zoning standards for comparable new construction. Adjacent to a single-family residential subdivision, development in the current C-1-district (Local Commercial) would have to provide a TY2 transition yard that is 10 feet deep. Should the property remain in its current C-1 District, a new retail building could be built within 30 feet of the residential properties and a loading area could be within 10 feet of the residential properties.

Based on the above analysis and findings staff has determined that the requested zoning map amendment meets the requirements of Sec. 27-335 of the Zoning Ordinance; therefore, staff recommends APPROVAL of the rezoning from the current C-1 (Local Commercial) District and Dunwoody Village Overlay District to the DV-4 (Village Center) District.

Dunwoody Tidbits - Village rezoning, Roberts Drive approved by Council but ZBA is next, hunting update, City Manager report, Holiday Lights at Brook Run, Christmas for Kids

Monday evening the Dunwoody City Council approved the new Dunwoody Village zoning regulations having worked diligently with many of the surrounding neighbors to ensure buffering protections are in place, therefore we also lifted the moratorium that was put into place.   Over the weekend before the Council meeting, the City was served with a lawsuit from the Shops of Dunwoody (including the Car Wash) disputing agreements and covenants that were put into place many years ago therefore the City carved them out of the rezoning and will attempt to settle facts and a way forward to add those properties back into the Village zoning along with proper neighbor buffering protections for larger buildings that may someday be built there.


 Roberts Drive Rezoning - Monday night council approved the allowance to build thirteen new homes where three once stood across the street from the Dunwoody Nature Center.  Residents on all sides were conflicted as to wanting or not wanting the new development as to the impacts to their property could be negative or positive depending on the layout, topography and concessions from the developer.  Even the Dunwoody Homeowners Association weighed in thinking the variances and the scope of the project was too problematic for approval.   In a rare 4 to 3 vote of Council the project was approved by Mayor Deutsch, councilors Tallmadge, Riticher and Seconder with Harris, Lambert and myself voting against.  The R-50 single home development should not exceed 40% lot coverage by code and these homes don't come close at 70% lot coverage.  The next step for the developer is the Zoning Board of Appeals who is meeting tonight at 6 pm to see if the request for approval falls within their allowances to legally approve the plan?


Council was briefed by the Georgia Department of Natural Resources to discuss hunting in Dunwoody where we learned of the state allowance for bow hunting in any section of the state and how we as a City can not modify or limit those activities on private owned land. Hunting to me in Dunwoody is both a safety and property rights issue whereby gun hunting is already outlawed and bow and arrow hunting is allowed by the State with the hope that common sense is used as there are limited safety requirements for bow hunting.

If we had five acre tracts with little chance of hunters, or wounded deer trespassing onto neighbors property, thereby forcing neighbors to participate / witness the hunting process, arrows might be fine with bow hunting; but with ¼ acre lots an injured deer will run and drop where not intended.  We have witnessed people (hunters) with no intention of following the laws on the books as they are running around shooting guns (breaking numerous laws) for hunting.  More laws on the books can not stop that from happening again.  In the case of the shooting that was caught on video on Mount Vernon, the tags were discovered on a camera and Dunwoody PD found out that hunters actually stole the pickup truck from Gwinnett County inorder to hunt in Dunwoody with a weapon. 

I also discovered that State Law to limit bow hunting will be hard to change because of a Georgia Constitutional Amendment that was passed in 2006.

We (the City) will be exploring options with the State but unsure where this issue will finally land, but I am guessing nothing is going to happen fast.   Long story short, gun hunting is illegal in Dunwoody and bow and arrow hunting is allowed by the State, whereby it cannot be controlled / limited by the municipality but instead would need State action (possibly another Constitutional Amendment) to change the law.


For the last couple of months, the City Manager, Mr. Eric Linton provides Council (the Community) highlights from the various city departments and the many things they are working on at Council's direction.  This week the update is 13 pages long and it is filled with numerous tidbits of information.
