FY2025 Mid-Year Budget Amendment

On 8/7, I updated the documents as I was able to upload them to my servers and I included my recap of Comp Plan Proposed changes.

* I am away from my normal computer system therefore can not upload documents to my servers therefore I recommend you review the city documents on their agenda system where you click onto each agenda item for documentation or you can download the entire packet here.

I recommend citizens with a financial background review the Dunwoody Audit & Comprehensive Financial Report for 2024 as I still have ongoing funding concerns for city expenses namely our rebidding of our contracted business services that was last renewed 5 years ago (at much lower prices than expected this year) as well inflationary pressures for expenses like salaries.  If you have questions for Council or staff, please raise them.

I have had number of citizen conversations regarding the comprehensive plan and my blog posts outlining my concerns & recommendations.  I look forward a conversation with council and then I will offer a few amendments including a few that were suggested by residents that thought I didn't go far enough in tightening up the language.  

I am not against the Holiday HQ proposal to spruce up the business areas but I believe the City Hall Facade Lighting is an overstep, not needed, nor possibly legal within our code if it were not on a governmental building.

Finally the FY2025 Mid-Year Budget Amendment really just cleans up the books as far as revenue received and shuffling a few accounts.  I will be asking about the funds being used for the Brook Run Maintenance Facility as this amendment uses  $461,000 from Unallocated Capital from the Shallowford Road proceeds but I would prefer that those funds be used for only front of house park development instead of a behind the scenes facility.  It may be a minor thing but in the spirit of the reason those funds were obtained I believe that was the intention of past Councils that those funds be allocated for playable park space. If you remember back on April 28th, Council narrowly approved (by a 4 to 3 vote) the $3.3 million back of house facility improvement whereby we only budgeted $1.5 million.  I was against this measure for both the cost over run as well as a portion of the excess funds ($1.5 Million) were coming from the sale of the Shallowford property and that measure mentions another $461K coming from unallocated capital but it didn't say where at that time.  Monday's amendment again shows coming from Shallowford and I would prefer that not be used.

Update on Edge City 2.0 Project

The City of Dunwoody would like to develop a new vision for the future redevelopment of the Perimeter Dunwoody market that is shared by elected officials, the DeKalb board of the Perimeter CID, major property owners, governmental partners, and community stakeholders.

The City of Dunwoody and ARC anticipate the following outcomes from the study to be:

  •  Provide an updated vision that reflects current conditions and 20-year build out.
  •  Develop transportation investments that provide for safe movement of pedestrians, bicycles, and transit in, through and around the Perimeter LCI area.
  •  Develop case studies of comparable edge cities that provide real world examples of what the district could look like under chosen growth scenario.
  •  Develop a 3D GIS model of the growth scenario that is compatible with the City of Dunwoody’s ESRI ArcGIS based System, and can be revised by city staff.
  •  Develop a Fiscal Impact Model for the city, county and school system that can be adjusted in future years and future economic conditions.

RFQ 22-02 Municipal Court Judge

City of Dunwoody contracts with Municipal Judges who operate on four year terms and it appears that we are entering a renegotiation or replacement phase at the end of June 2022.  Dunwoody has had a fantastic history of hiring outstanding Judges therefore if you are interested in serving and have the requisite qualifications, please review and complete the RFQ requirements.  In my own reading of the RFQ, I noticed the pricing was left blank and is part of the bidding process but if you are interested in seeing what we currently pay judges you can review the City's Open Checkbook and select the expenditure type as Municipal Court, Purchased & Contracted Services.

An RFQ has been issued by the City of Dunwoody (“City”) to seek proposals for the position of Municipal Court Judge from qualified individual attorneys. The City desires to enter into a professional services contract with a qualified Proposer who can demonstrate competency and experience in providing such legal services to municipal governments. Interested parties who possess the desired qualifications listed and are experienced in providing such legal services are encouraged to submit a Response to this Request for Qualifications.  At its sole discretion, the City may by direct negotiation, finalize terms with the service provider who is selected for the contract award. The City reserves the right to reject any or all responses for any reason.

Criteria
• Experience, expertise and knowledge of municipal legal processes and procedures.
• Demonstrate knowledge, experience and ability in the operation of local governmental units in Georgia; court procedures and substantive criminal and civil law;
• Experience with the supervision of the proper handling of any discovery requests related to a pending citation; and experience ensuring that proper and accurate records of dispositions are maintained.
• Proposal’s presented approach to ensure the efficient use of time and resources to reduce delays in court proceedings.
• Demonstrated ability to establish and maintain impartial and effective working relationships with other judges, judicial personnel, city management, elected officials and the general public.
• General familiarity with the City of Dunwoody.
• Fee Proposal

Proposer’s Qualifications
The Proposer shall comply with and be subject to all provisions of the City’s Charter and Codes, including, without limitation, the City’s Code of Ethics. Other specific qualifications include:
• Must be a resident of the State of Georgia and an Attorney-At-Law admitted to practice within the State and in good-standing with the State Bar of Georgia.
• Juris Doctorate degree from a law school accredited by the American Bar Association and an active member and in good standing with the Georgia State Bar Association. Possess any other necessary and up-to-date required licenses, registrations, certifications and continuing education units.
• The attorney designated to perform the services of the Municipal Court Judge shall have at least five (5) years’ relevant experience practicing law and/or as a judge or substitute judge in the State
of Georgia in a municipal court or a court of record.
• The Proposer also shall demonstrate a high degree of practical experience, knowledge, and ability in the operation of local governmental units in Georgia; criminal procedure and substantive criminal and civil law; management of a courtroom and a large docket of cases; efficient use of time and resources to reduce delays that inconvenience other Court personnel; supervision of the proper handling of any discovery requests related to a pending citation; and experience ensuring that proper and accurate records of dispositions are maintained.
• Certification that the individual is not debarred and has all necessary and/or required insurance coverage in effect.
• Skills, capabilities, capacity and work experience of a demonstrated level that would assure completion of the scope of work in a timely and satisfactory manner.

Dunwoody, GA – August 10, 2012 – In an effort to strengthen the community’s knowledge of municipal operations, the City of Dunwoody proudly announces the debut of the Dunwoody Government 101 educational series. The Dunwoody Government 101 series is an eight week course designed to enhance residents’ understanding of city government and offers the community a chance to experience and discover the primary undertakings of the City.

Dunwoody’s Government 101 series will provide participants with a look inside each of the City’s departments through a lively blend of demonstrations, presentations, and tours, all conducted in a casual format at numerous sites throughout the City. Participants can expect to come away with a heightened awareness and knowledge of local government operations as well as a greater understanding of how to get involved in local civic and community affairs.

Classes for the eight-week Government 101 series will be held each Tuesday evening beginning September 25, and concluding Tuesday, November 13, 2012. The sessions are free to attend and open to Dunwoody residents over the age of 18. 

“This type of community education serves an important function in a democracy, especially in a large and complex society like ours,” said Dunwoody Mayor Mike Davis.  “Our goal is to help create an informed and involved community and access to this information is all part of helping promote civic engagement and community collaboration.”

Interested participants should complete the Dunwoody Government 101 application which is available online at Dunwoodyga.gov, or at City Hall. Completed forms may be sent to Edie Damann at edie.damann@dunwoodyga.gov, dropped-off, or faxed to 678-382-6701.

DeKalb County Court Watch Training


Dear Council Member Heneghan,

Thank you again for working with us and introducing the Proclamation about Teen Dating Violence.  I am writing to introduce you to introduce you to Sonja Brown, our Community Prosecutor, who is organizing the first ever DeKalb County Court Watch training, which is scheduled for Saturday, May 5, 2012 from 9 AM – Noon in the Jury Assembly Room at the DeKalb County Courthouse, 556 N. McDonough Street, Decatur, GA 30030.  Registration opens at 8 AM and training will begin promptly at 9 AM.

Court Watch is a collaborative, community-based approach to criminal justice, developed to help the community gain a better understanding of how the court system works.  Court Watch provides an opportunity for community members to attend court hearings of those cases that are important to their respective communities, and to monitor those cases through the criminal justice system.  The Court Watch goals include:

  • Educating the community about how the court system works;
  • Encouraging community members to attend and observe court hearings;
  • Having input in the criminal justice process, which increases accountability;
  • Representing the community’s interest in the criminal justice system;
  • Enhancing awareness among judges and prosecutors about the personal impacts of being crime victims, so that these issues can be taken into consideration in case prioritization and sentencing; and
  • Developing better relationships between the courts, prosecutors, law enforcement and the community

During the training, participants will have an opportunity to learn about and understand the important aspects of the criminal justice system in DeKalb County.  They will also have an opportunity to hear presentations from the Solicitor-General’s office, DeKalb County Police Department, the Sheriff’s Department, Superior and State Court Judges, Probation, and an active Court Watcher from a neighboring jurisdiction.

State of the Municipal Court of Dunwoody given by Judge J. Antonio DelCampo

In the Municipal Court of Dunwoody we handle all traffic citations and ordinances within the boundaries of the city limits of Dunwoody, Georgia. We held our first court session on February 25, 2009 in the South Terraces.

In 2009 the Court held 53 court sessions, 8723 citations were filed with the court and 628 defendants were placed on probation. Of those probationers, 3556 hours of community service hours were completed. The Court’s revenue for 2009 was $645,901.

In 2010 the Court held 90 court sessions, 7469 citations were filed with the court and 1171 defendants were placed on probation. Of those probationers, 17,833 hours of community service were completed. The Court’s revenue for 2010 was $1,143,548, with a budget of approximately $325,000.

Dunwoody Municipal Court is held twice a week on Tuesday mornings and Wednesday evenings, with either Judge Rick Powell or me. We also have Judge Timothy Wolfe, Pro Hac Judge, and formerly we had Sherry Boston, now Solicitor General for DeKalb County.

We are assisted by our Solicitor’s Office, which includes our City Attorney, Brian Anderson, as well as Don Henderson and LaTonya Hayes. Our Clerk of Court, Trina Gallien, is assisted by Deputy Clerks Melissa Thomas and Janieux Irving.

Our court is transitioning to a paperless court system. We are able to access the citations, reports, and sentencing forms electronically. My signature is my secured fingerprint.

We have a private probation provider, Sentinel Offender Services, which is at no cost to the City. The program is offender paid, with probation required for certain types of cases such as DUI. DUI cases require community service, alcohol and drug evaluations, risk reduction and one year supervised probation.

In 2009 Sentinel Offender Services had approximately a 47% successful completion rate; 628 probationers, with 297 successfully completing the program. In 2010 they had approximately an 83% successful completion rate; 1171 probationers, with 975 successfully completing the program. In 2009 probationers were not placed on probation long enough to complete the program, opposed to 2010. You need more time to complete all conditions including paying fines to avoid expiration of the case.

I would like to take this opportunity to thank all of our bailiffs who volunteer their time to the Court. They are: Larry Echikson, Jim Beattie, Ron Silvers, Jim Sturgis, Stan Bernstein, and Chris Doyle and they are all residents of the City of Dunwoody. To them, a huge thank you. They are the face of your Municipal Court, serving their community.

We have a great Municipal Court. We are efficient and treat people with respect. The court process is a swift and efficient process. People are treated fairly and they are being heard and we strive to create that here in the City of Dunwoody.

Hon. Judge Sherry Boston of Dunwoody becomes the new solicitor-general for DeKalb County

Judge Sherry Boston will be stepping down from the Dunwoody Municipal Bench to serve all the residents of DeKalb County. Governor Sonny Perdue announced on Friday the appointment of Sherry Boston as the solicitor-general for DeKalb County as she fills the vacancy left by Mr. Robert James who was just elected to the DeKalb District Attorney position.

Sherry is a true professional and a wonderful person, we were blessed to have her on our bench. All the best Judge Boston!!

Real Time Dunwoody Crime Stats Hit The Web


The City of Dunwoody didn't exist a year and a half ago therefore when laying out a data infrastructure we were at an advantage of not having years of data tied up in legacy systems. We decided early on to invest in best of breed interrelated systems whereby the various computer systems would talk to one another and share all related data. For example, we assured that the police citations were electronic, the information could be uploaded wirelessly from the cars, input into the court management software and then tied the court payments into the city's financial system. Though these records management software systems were expensive on the front end, the amount of manpower savings over time will prove that these were wise purchases.

Today the Dunwoody Police Department implemented the latest records management system to come on line, the Police-to-Citizen (P2C) software package now pushes the last seven days of police reports onto the web for all to see. The OSSI P2C Application is a browser-based solution that provides a convenient solution for citizens to perform simple searches and to map the results.  On many of the event searches, residents can easily click the document view icon listed on the right of the results and the complete incident report is downloaded in a pdf document.

In playing with the software, I like what I see but there are a number of improvements that might be able to be made. First the software package doesn't like any browser software except Microsoft Internet Explorer, so I guess you just need to know that on the front end. Second the Daily Bulletin should have an option for daily e-mail delivery, since I know a number of people who would be signing up for that if it was offered. Third, the software allows the printing of incident reports straight from the web but for traffic accident reports it asks that the report be requested from City Hall after paying a $5 processing fee. Knowing that this fee covers the processing cost, I would like to see the city to explore an on-line payment for the accident reports and therefore allow direct access via the web. Finally, my last question regarding the data is why was the access limited to only seven days? Was this a function of the software or was it a city decision programed into the software?

In this day of high tech computer databases and instant information; how much do we really want to know about our neighbors and those who live around us?  How much is needed for public safety and how much is just voyeuristic curiosity?   I guess I enjoy having my DeKalb Mugs emailed to me daily based on the offenders home address and then I'm very capable of checking the status of all criminal and civil cases on the DeKalb OJS (Online Judicial System) when ever I feel I have the need to do so.  The real question is what do the residents of the City of Dunwoody want published on this database and for how long should it be available?  When my wife, or your son little Johnny gets a speeding ticket, should it still be able to be found on our public access website a month or two later after the matter has been settled?

I don't know the answer, but I will be asking my wife in the morning.
