State Farm complex in Dunwoody looks to grow - @KDC_Development proposes high rise residential / hotel next to Marta Station. @troutmanpepper @AtlBizChron @WhatNowAtlanta

This development proposal will be going in front of the Dunwoody Planning Commission on Tuesday February 13th and then in a month or two the proposal most likely will be making it to the full City Council for review and decision.

The site is located at 245 Perimeter Center Parkway, Dunwoody, GA 30346, on the west side of Perimeter Center Parkway and the south side of Hammond Road. The lot is the last remaining piece of the Park Center development which abuts the Fulton County line to the west and vacant land owned by the City to the south. The applicant seeks permission to rezone the subject property from PDc to PDc; this rezoning does not affect the zoning classification of the property, but rather is an amendment of the zoning conditions of case RZ 15-72, as it relates to the future development of the subject parcel.

The 2015 Overall Development Plan, which sets the limits and zoning regulations for the development, entitled the applicant to the following:

• 1.8 million square feet of office space
• 90,000 square feet of retail/restaurant space
• 7,000 structured parking spaces
• Maximum height of 35 stories above the plaza level
• The subject property was not addressed and was left as greenspace

Based on the proposal above, a DRI (development of regional impact study) was completed along with the 2015 rezoning and was approved. As a part of that process, the applicant conducted a detailed Traffic Impact Study which included Trip Generation and Access Analysis. The recommendations from the 2015 DRI were fulfilled with the development of Park Center buildings 2 & 3. In 2023, the applicant has submitted its plans to the Atlanta Regional Commission, which compared the anticipated traffic impacts with the 2015 DRI plans. The now-proposed development of the subject property would not create worse impacts so, per the Community Development Director and the Atlanta Regional Commission, another DRI was not necessary.

Since 2015, two office buildings, Park Center buildings 2 & 3, have been constructed and completed in 2021 and 2022. Following these developments, the property is currently entitled to the remaining 729,613 SF of office, 33,586 SF of restaurant/retail, and 2,833 structured parking spaces. The applicant proposes to construct a new building, Building 4, on the subject property and requests to construct up to 300,000 SF of office space, 300 multi-family residential units, 175 hotel rooms, 22,000 square feet of restaurant/retail, and 1,565 square feet of structured parking spaces, with a maximum building height of 37 stories. The request for multi-family residential and a hotel are not permitted under the 2015 Overall Development Plan and are new uses requested.

The current zoning of this property is Planned Development District (PD). PD districts are not subject to regulations dictated by the zoning ordinance; instead, the uses and site and building regulations are dictated by the Overall Development Plan (ODP). The existing ODP from 2015, which covers the entirety of Park Center, does not anticipate residential multi-family dwelling units. Due to this designation, development of this property with the proposed mix of uses at this site requires a zoning map amendment.

The applicant proposes to amend the ODP for the subject property to allow Building 4 to have the following proportion of uses:

• Up to 300,000 SF of office
• Up to 175 hotel rooms
• Up to 22,000 SF of restaurant/retail/other permitted uses
• Up to 300 multi-family residential units

Additional residential development within such close proximity to the Dunwoody MARTA station, Campus 244, High Street, and the mall will serve to further activate this area of Perimeter Center. New residential units will complement the surrounding uses, by allowing nearby employees an opportunity to live within walking distance to their job; additional residential units will also further support the new retail, restaurant, and entertainment nearby. A number of the retail spaces at Park Center were intended to cater to office employees. Due to remote work and overall office space vacancy, the number of customers is much lower than initially anticipated. Adding hotel and apartment units to the mix will diversify the customer base with people working remotely or visiting the area.

The proposed use mix reduces both peak AM and PM hour traffic and thus reduces the development’s impact on congestion. Car dependency is further reduced by the increasing walkability of the Perimeter Center and the proximity to the Dunwoody MARTA station, which would provide future residents with convenient commute alternatives.

The current economic conditions, which began during the global COVID-19 pandemic, have significantly reduced the need for new office development and as demonstrated in the Edge City 2.0 study, the need for residential development is very strong, especially near MARTA. Overall, development of Building 4 under the current entitlements, as an office building, is not feasible and the proposed mix of uses would be a benefit to the Park Center campus and the surrounding area.

Heneghan comment - The Dunwoody City Council set the hotel tax rate of 5% back in 2009 and raising it has not been discussed previously.  Other nearby cities are about to offer a bill in the state legislature to raise their hotel tax rate and our hoteliers along with the Dunwoody Convention & Visitors Bureau are favorable of the rate increase here in Dunwoody.   I believe the reason for this special meeting was to pass this reolution to make a state legislature deadline to be added to a tax increase bill being drafted for other cities.  Neither this act or the act of the state will raise the taxes but both together would allow us to come back and set the final rate if appropriate and projects are tied to the revenue.

I will be missing the meeting in the morning but I believe the additional revenue would eventually need to be earmarked on items benefiting the hotel guests, possibly nearby park amenities, dedicated paths to restaurant areas or shopping; if that is not the case per law - it would be my desire to spend the additional revenue benefiting those who pay the taxes. A slide presented to Council during our retreat states that the revenue must be for physical attractions/facilities that are available and open to the public, improve destination appeal to visitors, and used by and supportive of the visitor experience. If that is the case, I would be interested in learning those project details as I do not believe they are completely hammered out.  John

To approve a resolution requesting state to allow Council to vote for authorization to increase the City’s hotel tax rate to an amount not to exceed 8%.

Presently, the City has a 5% hotel excise tax for the room and authorized related charges. For 2016, each percent yielded tax revenues of $533,837 to be used as required by state law. Dunwoody may levy and collect an excise tax of a rate of up to 3 percent or at a rate of 5,6,7 or 8 percent on charges made for rooms, lodging or accommodations furnished by our hotels. Under state law, Dunwoody may do so only after the passage of local legislation authorizing the tax.

As an initial step, after consulting with relevant destination marketing organizations, hotel owners, and others in the tourism industry, any city considering an increase in its tax rate will adopt a resolution stating the proposed new hotel-motel tax rate, the allocation of proceeds, and the projects, if any, that will be funded by the tax. This resolution does not set Dunwoody’s tax rate. Neither will the state legislation being requested by the resolution. It merely adds a tool to the tool chest that allows Council to consider and subsequently adopt an appropriate amount to be used in accordance with state law. That rate and use will be vetted and considered at a later time; allowing vested parties to participate in the process to both set the rate and identify the usage.

Under the new process, the city is required to spend the tax revenues that would be collected at the rate of 5 percent in accordance with the general 5 percent tax rate authorized in O.C.G.A. § 48-13-51(a)(3). At least half of the tax revenues collected in excess of amounts that would be collected at the rate of 5 percent are required to be spent through a contract with a destination marketing organization (CVBD) for purposes of promoting tourism, trade shows and conventions. The remaining revenues, if any, collected in excess of amounts that would be collected at the rate of 5 percent are required to be spent for tourism product development.

ALTERNATIVES
Council may choose to reject or postpone the resolution. Such action will prevent the legislation from being adopted at the state level due to deadlines for advertising and consideration by state  representatives.

RECOMMENDED ACTION
Staff recommends the Council approve the resolution asking the state to authorize the City to adopt a hotel tax rate not to exceed 8% to be used in accordance with state law.

Would you like to hang out at Brook Run Park a little more this summer?   The City of Dunwoody is exploring options and looking for proposals for a possible Tree Canopy Obstacle Course at Brook Run Park.  No other details except what is on city site.  Thoughts?

I am receiving comments via email on the various intersection proposals for the Chamblee Dunwoody / Spalding Drive intersection.  A meeting with formal presentation took place on Feb 25th and the city staff is still accepting formal comments on which proposal you prefer.  Also take a look at the City of Dunwoody's YouTube page to see four videos of traffic scenarios for the intersection including the one way proposal.

Tuesday the Dunwoody Planning Commission reviews a rezoning on Old Spring House Lane to change land zoned for offices to 120 unit residential complex for Senior Living.

At the Wednesday meeting of the Village Design Review Advisory Committee they are discussing a new sign to be installed in the Dunwoody Hall (Publix's) Shopping Center on Chamblee Dunwoody for what appears to be a new pet store concept by Petco called; "Unleashed for dogs and cats."

At the Thursday morning Sustainability Committee they are discussing a city sustainability plan and possible designated parking for electric vehicles.

At the Thursday evening Community Council meeting they are discussing two possible property rezonings.  The first asks to rezone a piece of property on Crown Point Parkway from a proposed 120 room hotel to instead allow a self storage building in its place.  The second asks to rezone a property on Ashford Dunwoody Road where 257 multifamily residential units are currently allowed and instead allow a 128 room hotel and commercial space for retail or restaurant.

I was invited to this special called meeting of the Dunwoody City Council but there is little or no other documentation available therefore I expect that we will be called into Executive Session to discuss a "personnel matter" and if there is an official nomination by Mayor Davis that we will come out to discuss and approve the action publicly. I have no inside information on this though there are a number of City Department Heads who could easily hold the acting position for several months and/or the position could be filled by a "Loaned Executive" or even a person from the community. 
The initial decision is the choice of the Mayor and he may or may not be waiting until the Dunwoody Talk - March City Manager Madness Tournament is complete.

Biznow.com Atlanta reports - Hotel Equities plans to break ground this year on a 132-key Hampton Inn and a 124-key Residence Inn. The Hampton Inn will be next to Sterling Point office park off Ashford-Dunwoody Road; the Residence Inn will connect to the current home of the Spruill Center for the Arts. We had a sprawling interview with Hotel Equities' COO Brad Rahinsky yesterday during the Hunter Hotel Conference at the Marriott Marquis in Downtown Atlanta.  Brad says Central Perimeter is justifying the additional rooms in large part thanks to State Farm, which has tightened the office market and helped supply not only occupancy increases during the week, but on the weekends as well. Hotel Equities owns the Fairfield Inn & Suites in Sandy Springs, where nightly rates have climbed past $200. Plus, to offset development costs, Brad says it's selling four outparcels at its Hampton site, one already slated for a Corner Cafe. “The revenue that would be thrown off on those outparcels will pay for the debt service,” he says. “[The Hampton] starts cash flowing the day we open the doors.

City of Dunwoody items that I follow as they will soon be coming in front of me on Council


On Tuesday, the Dunwoody Planning Commission approved the site design for a new hotel.
The DHA in April opposed the project because of its access to Ashford Dunwoody, one of the city’s busiest streets. But after the developers negotiated with DHA representatives and agreed to allow only right turns into the property from Ashford Dunwoody, the association changed its position. The new design also includes full access to the property from Perimeter Center North. DHA president Stacey Harris attended the June 11 planning commission meeting to express the group’s support for the new plan. “We think this is a fabulous compromise,” she told the commission. “It’s good.”
This morning, the Dunwoody City Council held a rare week day special called meeting to conduct a hearing on the 2014 tax rate which is holding the same rate since the original date of incorporation.  We also had a first read leasing a building on Shallowford Road at Peachford and a quick discussion regarding the operations of Food Truck Thursdays.

Following the City Council meeting, the City Ethics Committee met and approved a recommendation to City Council for a public reprimand of Dr. Bonser for conduct failing to meet the requirements of courtesy in relation to an email she sent.
Board Member Bahr move that the Board recommend to City Council for a public reprimand of Dr. Bonser for conduct failing to meet the requirements of courtesy in relation to her February 3, 2013 email. That the further recommendations of the hearing officer, with respect to revocation of email privileges be not recommended and that the Board is split with respect to the issuance of a strong letter of encouragement to Dr. Bonser with respect to apologizing in writing to the complainant.
Thursday night the Dunwoody Community Council will discuss the items in the Zoning & Land Development Rewrite. The Sounding Board of Citizens who served seemed to have a solid consensus on most of the proposed changes (Highlights available in this link) except for maybe Home Occupations allowing customer contact.  Here’s the meeting and hearing schedule for this important topic - 6/13: Community Council; 7/9: Planning Commission; 8/12 & 8/26: Mayor and Council.

Monday Night, June 17 from 6 p.m. - 8 p.m. there will be an Open House at St. Luke’s Presbyterian Church, 1978 Mt Vernon Rd to discuss future plans for Mt. Vernon Rd. and Vermack Rd / Manhasset Drive engineering improvement.
The City of Dunwoody is interested in hearing your input and feedback on future plans and project improvements which enhance the quality of life for everyone within our City. The intersection at Mt. Vernon Rd. and Vermack Rd/Manhasset Drive has been identified in the City of Dunwoody’s Comprehensive Transportation Plan as a high priority project due to its current poor level of service. Mount Vernon Road is one of the primary east-west corridors in the City and Vermack Road provides access to Dunwoody High School and Vanderlyn Elementary School. The current intersection is signalized but lacks turn lanes, causing longer traffic queues and wait times, and remains deficient in accommodating safe use by pedestrians and bicyclists. The City is currently in the early planning stages/data-gathering phase during which public input, land survey and traffic counts are obtained to best determine appropriate engineering improvements for the intersection. Proposed Ashford Dunwoody Hotel presents to DHA and hears concerns on curb cut.




Mr. Den Webb of Smith, Gambrell & Russell presented to the Dunwoody Homeowners Association on behalf of the hotel developer Mr. Don Boyken and the main community objection was lead by Mr. Bob Lundsten who detailed his objections on his Dunwoody Farmer Bob Blog.

I do not sit in any official capacity on the Board of the Dunwoody Homeowners Association, though I regularly attend the public portion just as anyone interested can do.   As an interested member of the public, I observe and learn all I can on items that may came in front of me on the City Council and left the meeting prior to the private discussion and recommendation.  Council members Thompson and Nall were also in attendance at the Sunday DHA Meeting and did the same. 

The Dunwoody Planning Commission will be hearing this item on April 24th and I will also be observing that process and the presentation.

Dunwoody City Planning - Tennis Courts, Tornado Shelters and the Code Red Emergency Service


I came across a Tweet on Twitter which highlighted an interview that Mayor Davis gave describing a possible development situation for a large empty corporate building located immediately behind the old Best Buy (new Nordstrom Rack) store on Hammond.   If you read the article you will see that the idea being floated by the Mayor was an increase in the hotel tax to pay for a sports complex which could then be used draw visitors to our city. 

The location is immediately adjacent to 285, next to the Marriott Hotel and close to the Dunwoody Marta Station.  This location is also near several parcels (Fudruckers & Chequers) that at one time had plans drawn up for a condo / residential office project but instead of a Transit Orientated Development; I would prefer Hotel/Office and possible high rise condo development on that land.

My personal preference for the 15 acre GoldKist property (if the 1970's corporate office complex is no longer viable) would be a small Convention Center / Hotel complex at the location, or nearby, to tie into Marta and future hotels as I believe convention floor space is lacking in the Top End.  I understand the traffic issue but also believe the new flyover bridge of Perimeter Center Pky could be utilized in the design and possibly someday feed 285 with the redesign of the 285/400 corridor. 

I am proud that Mayor Davis is willing to float ideas to improve the city and I truly encourage my fellow elected officials and all citizens to do the same.  Not every idea can a winner and I don't have enough information to judge this one, but why not throw it out there for public review?  Leaders have vision and are willing to do that as well as listen to ideas that differ from their own.


More important than long range city planning, I believe public safety is government's number one responsibility and I can tell you we take that charge seriously.  The idea of tornado sirens has been broached in the past but Council has passed on the idea due to cost, implementation and the now prevalence of double pane insulated glass which would muffle the sirens. Instead Dunwoody hopes that everyone is registered with DeKalb County Code Red  for their emergency notification service as well as heeds all other public weather notifications given by the media.   Other than sirens and encouraging personal readiness, the city staff has been exploring what to do as far as emergency shelters, in case they were ever needed.  Ms. Pattie Baker has been pushing this idea and we are exploring options with the schools and the college, but with the city government not owning any newly constructed public city buildings like a police station or city hall, our options are limited.  Other options like agreements with hotels might be possible but are still being explored.

Artistic Le Méridien hotel to open in Dunwoody

The 275-room Atlanta Perimeter Hotel & Suites on Ashford Dunwoody Rd which was recently a W Hotel will be rebranded as a Le Méridien.

The Parisian-inspired brand was acquired by Starwood Hotels & Resorts Worldwide Inc. about six years ago and is now expected to grow significantly.

“We are very excited about the opportunity to work with this new brand,” said Katie Brenckle, Executive Director of the Convention and Visitors Bureau of Dunwoody. “I think it’s going to be a good thing for that property, for the location and the market.”

Dunwoody's Marriott Perimeter Center Hotel to renovate everything but the I-Beams

Marriott Perimeter Center is slated for a head-to-toe remodel beginning May 20, according to highly placed Marriott insiders.  The Dunwoody hotel at 246 Perimeter Center Parkway near Perimeter Mall estimates a $22 million property renovation to be completed by December, Marriott insiders shared with What Now Atlanta Monday.  Marriott Perimeter Center will renovate their guestrooms and suites, lobby, bar, restaurant, meeting space, concierge lounge, exterior and landscaping.

To begin the renovation process, the hotel will close the tower portion of the property in May to renovate 236 guestrooms, adding wired and wireless internet access and 37 inch HDTV’s. Meeting space and 164 guestrooms will still be available when renovations commence.  In August, the hotel will begin renovations to their public spaces:
  • Lobby reinvention– addition of work tables, “social cubbies,” sofa’s and a “day/night bar.”
  • In-house restaurant reinvention.
  • Addition of 3,400 square feet of meeting space to the lobby level.
  • “Revitalized concierge lounge” with a “window dining counter and soft seating.”
  • “Exterior and lush landscaping” renovations.
In September, the hotel will renovate the remaining guestrooms opening the newly renovated 236 guestrooms to the public.
