Special Called Dunwoody City Council Meeting, Tuesday April 1st, 5:30 pm - Vintage Pizza to discuss updated Comprehensive Land Use Plan (Joint Zoning Meeting - 40 participants)

DUNWOODY CITY COUNCIL, DEVELOPMENT AUTHORITY, PLANNING COMMISSION, ZBA

SPECIAL CALLED MEETING

APRIL 01, 2025 - 5:30 PM

VINTAGE PIZZERIA

5510 CHAMBLEE DUNWOODY ROAD

DUNWOODY, GEORGIA 30338

Tuesday evening there will be a special called meeting of the Dunwoody City Council, actually it is a huge public meeting at Vintage Pizza on Chamblee Dunwoody Rd at 5:30 pm that will be taking place in order to inform the four zoning committees within the City of Dunwoody of the work of an ad-hock steering committee being led by staff direction and that of outside consultants.   As this is a City Council Meeting, there will be 30 mins of Public Comment time available at the start and end of the meeting but as it is taking place off site (away from City Hall), it does not look to be streamed or recorded as usual.

All four of the zoning committees in the meeting on Tuesday are either elected by the citizens or confirmed by City Council whereby the invited representatives in the audience will be the City Council, the Planning Commission, the Zoning Board of Appeals and the Development Authority.  These individuals as well as I am guessing the Comprehensive Plan Steering Committee are named down below.

The Comprehensive Land Use Plan is required to be updated by state law but this time around we are looking to also update our zoning code into a Unified Development Ordinance.  Based on the timelines previously presented I am guessing the first draft of the community agenda outlining the community vision, goals & policies will be presented soon if not on Tuesday.

Right now redevelopment in the City of Dunwoody is thoughtful but slow with lots of eyes on every project whereby with a good presentation, quality data and appropriate community / neighbor backing; anything can get approved after it is properly vetted.   Slow is not a bad thing when the proposed development is immediately next door, or the change will allow a development to move forward which might change the character and feel of the community.

I have not yet seen any proposed changes to the Comprehensive Land Use Plan and then the underlining Development Ordinance; but my concern is that it may be proposing land use changes by right, whereby a developer can do what he wants within the limits of the allowances, without the scrutiny of the public nor an approval of the Council.   I will be listening attentively during the meeting as this process and the proposed changes could have unintended consequences if not thoroughly reviewed prior to codification and approval.

City of Dunwoody's Comprehensive Plan & Unified Development Ordinance

Project Update: On Jan. 27, 2025, the project team presented an update to the Dunwoody City Council.

Recurring themes:

  •         There is a need for additional housing in both quantity and type, particularly for first-time buyers and seniors.
  •         Residents would like to see a “Downtown Dunwoody” with walkable shops and restaurants.
  •         Residents love local centers like Dunwoody Village and want to see these places to grow and thrive.
  •         There is concern over vacant retail and office spaces impacting economic development & growth.
  •         Traffic congestion is a major issue, and people want more connectivity and ways to get around.
  •         People want to see their neighborhood character and greenspaces preserved.

There were several special called meetings that took place in June while I was away on vacation that were called to have preliminary hearings on the setting the Millage Tax Rate for the City.   The tax rate is not changing as we are already at the maximum allowed per the charter but there was a 3% increase in the valuations therefore we need to advertise this as a tax increase.  Reminder that homeowners with an Homestead exemption and freeze in place, will not see a City of Dunwoody millage tax increase over last year.  Besides the millage rate item, the first special called meeting the evening of June 26th, had a few other items on the agenda I wanted to recognize.

City of Dunwoody to hold Joint City Council, Planning Commision and Development Authority session Tuesday Night - 6 p.m. (State of Perimeter Commercial Market 2023 & Edge City)

Tuesday evening at 6 p.m. there will be a rare Joint meeting of the Dunwoody City Council, the Dunwoody Planning Commission and the Dunwoody Development Authority to receive an update on the current state of the commercial market.  Yesterday in my blog post on the Monday Budget Committee Meeting, I posted an opinion from Colliers on the financial real estate health of the Central Perimeter Business District and I am guessing this Tuesday evening briefing will also bring forward more information.

I am also guessing that this meeting will count as training to assure that we are all following proper zoning practices to make our decisions.   The city has posted the agenda but no other documents for this meeting, that may change by Tuesday afternoon so please do check the City site in the agenda link below.

Here are some previous documents from the Edge City Study that is on the agenda.

Edge City 2.0 Update May vs Edge City 2.0 Update January

That being said, this meeting looks to have both Zoom access and public comment for those who may want to give feedback to the collective zoning decision makers in the community.   Below are the links.

Dunwoody resident asks, "Why can't we have nice things like our neighbors?"

Just because it is not easy, doesn't mean we are working towards these goals

Part of the job of serving on the City Council is knowing what the residents of your city want and then trying to fulfill their desires with the resources that you have available, unfortunately, the desires always outweigh resources.  I read everything Dunwoody related that I can get my hands upon and that includes newspapers, Facebook, Twitter, YouTube, podcasts, various Blogs, AHA, Letters to the Editor, e-mails directed to Council, Myspace and sometimes I will even read Nextdoor.  If it is Dunwoody related, I read it.  If someone needs assistance I jump in, if it is a general conversation I may just watch the conversation but I rarely jump deep into Facebook conversations as I usually have my own platform for communication and the Open Records laws regarding social media communication for elected officials is murky at best.

Anyway, I saw a conversation on Dunwoody (and specifically Dunwoody Village) being compared to to the new Town Center mixed-use development in Peachtree Corners whereby the city purchased a patch of forest on Peachtree Parkway across from the Forum and turned it into a shopping area with an activated outdoor dining, drinking/recreation area with music events from time to time.

Maybe my heart was still pumping hard from this evenings spin class, or I ate too many treats at the Dunwoody Community Garden 10 year celebration or I was too hyped up from whipping my boys at Foosball; either way, I broke down and commented on a group Facebook post.   My answer was detailed, addressing not only her question but also some of the other comments on the post and figured in the sense of transparency that it was worth me posting here as well.
____________________________________________________________

To loosely recap the question, it was Why can't Dunwoody have nice things like outdoor dining in a pretty park setting and then be able to walk around listening to music as I sip my wine?

My answer was ... I don't think anyone disagrees with you, we would all want that. The City of Dunwoody wishes they could buy a chunk of undeveloped land to do what Peachtree Corners did or be like Sandy Springs and be able to afford to buy out profitable businesses - but neither option is easy for us to do.

Regency owns the Village shopping center and we have made it easier for them to redevelop by unregulating the area including the corner property on Chamblee Dunwoody & Mount Vernon that sits vacant for years. Regency owns much of the property and they and the other owners decide if major changes are desired, not us - but we continue the discussions. If the City moved forward, purchasing a chunk of the parking lot from Regency and made it into a park, would Regency try to redevelop around it or would it be a patch of green surrounded by asphalt? Having the City buy a chunk of land from Regency in order to build a parking lot, what would Regency do with that multi-million dollar amenity?

The City redeveloped the old pipe farm off Chamblee Dunwoody and now has several restaurant parcels abutting open green space and a park available at Shallowford and Perimeter Park yet we can't find a developer willing to move this idea forward. Economics and the number of eyeballs driving by always come into play on developments like this and there are a lot more cars driving by on Peachtree Parkway in Peachtree Corners.

Dunwoody with the help of DHA puts forward Food Trucks with bands and the City hosts other events either by itself or partnering with the Dunwoody Nature Center, so you can't say we are not trying.

As far as permanent restaurants in Brook Run, I'm not against it (think Park Tavern or Tavern on the Green) but I am sure food trucks will be involved anytime crowds are expected. When the amphitheater is completed, I am guessing we will be scheduling a regular concert series with tables for purchase via subscription service and free concerts otherwise. I fully expect outside food and beverage service being available if you don't bring your own.

Long story, short - the City is trying to foster the items that you desire and are working towards the future with the funds we have available but when it comes to modifying existing commercial development sometimes it is easier said than done. Just because it is not easy, doesn't mean we are not working towards these goals behind the scenes.

Thanks

John Heneghan
Dunwoody City Council

PS: Earlier this week the High Street ATL huge development next to Perimeter Mall and the Marta Station which many compare to the Avalon in Alpharetta just dropped their phase 1 plan off at Dunwoody City Hall and this development will include hotel site, retail, office, parking, and about 600 apartments. The zoning on site that was put in many years ago allows up to 1,500 apartments and 1,500 condos and based on recent actions the development that has been on-again / off-again for many years may finally be coming out of the ground. I plan on reviewing and posting the High Street plans as soon as I get my hands on them.

Dunwoody City Council discusses economic redevelopment of commercial areas.

http://jkheneghan.com/city/meetings/2018/Jun/Council_Retreat_6-4-18_Final.pdf

Several hours of conversation regarding future commercial redevelopment - there were several reporters in the room and the meeting was live streamed so these are just my quick notes as I am sure more information will be following from others.

Dunwoody Village
  • Need to remove or greatly modify the architectural standards in Dunwoody code.
  • Need to allow flat roofs & modify parking requirements.
  • There are a number of prime redevelopment opportunities available - City should move sooner rather than later on proposed zoning changes.
  • Improve both pedestrian and vehicle circulation as well as aesthetics.
  • Major redevelopment is waiting on one primary commercial land owner who is happy as is.

Georgetown
  • City / Development Authority could review opportunities adjacent to city property already owned.
  • City owns land near Pernoshal Park (Emory and other offices) as well as Shallowford / Peachford building where a new road could spur redevelopment of Dunwoody Park (single level office park).
  • DeKalb School property on Chamblee Dunwoody is also ripe for redevelopment.
  • New opportunities / challenges as Shallowford Rd is discussed as an access point to managed (Toll) lanes along 285.
  • New restaurants are coming soon to the Park at Georgetown.
  • Georgetown Gateway (Chamblee Dunwoody Rd) will be re-landscaped.

Perimeter Center
  • Lots of office and redevelopment happening near the Marta Station.
  • New hotels, new restaurants are coming and expect to see a higher use to be pushed where possible as redevelopment opportunities present themselves.
  • State Farm has several buildings under construction & High Street will add density.
  • The current location of P.F. Changes where Brio and McCormick & Schmick's closed was mentioned as a possible different higher use.
  • Transportation improvements including the Westside Connector and  the managed lanes.

2016 Real Estate Valuations Issued For Dunwoody

City’s Millage Rate of 2.74 Will Not Rise

The city received notice of its fourth year-over-year increase in the real and personal tax digest for 2016 as a result of the revaluation of real property tax assessments performed by the DeKalb County Tax Commissioner’s office. Notwithstanding this increase in the overall tax digest for real property, the digest is relatively unchanged having increased less than 8 percent since the city’s incorporation in 2008.

Dunwoody homeowners who filed and qualified for a homestead exemption will pay no more in city taxes than the amount they paid in 2009 based on the residential property assessment freeze exemption effective since the city’s inception.  This exemption is in addition to the one (1) mill exemption also in place granting homeowners in Dunwoody an effective millage rate of just 1.74 mills.

By keeping the millage rate at 2.74 mills since incorporation, one of the lowest millage rates of any similarly-sized citywithin the immediate Atlanta metro area, Dunwoody property owners may see an increase or a decrease in their real estate taxes in 2016, depending on whether individual property gained or lost value this year. The City of Dunwoody does not have direct control or influence over the valuations of the tax assessor’s office.

In accordance with state law requirements, the City of Dunwoody will hold three public hearings to receive comment from taxpayers on aspects of the recent revaluation of real property tax assessments. The public is invited to attend information meetings at Dunwoody City Hall located at 41 Perimeter Center East Dunwoody, Ga. 30346 on:
·         June 6, 2016 at 8:00 a.m.
·         June 6, 2015 at 6:00 p.m.

The City Council will have a third and final public hearing followed by a vote on a tax rate for FY 2016 at the City Council Meeting held on June 13, 2016 at 6:00 p.m.
