Dunwoody City Council approves lawsuit settlement to allow three Group Residential Behavioral Health Treatment Facilities without SLUP process.

Monday evening there was a Special Called 5 pm meeting to go into Executive Session followed by an action item for Council to vote on a Settlement Agreement.    The following legal item was brought into the public domain once it was approved by the City Council and this happened at that Special Called Meeting; therefore this document can now be shared.

I have printed a few paragraphs outlining the actions below for your awareness and though disappointed in the reversal of a zoning action; this settlement agreement was put forward in the best interest of the City as whole.

Notwithstanding the current SLUP Requirement related to operation of certain community residences or recovery communities, the City will issue the necessary occupational tax certificate licenses for the corporate Plaintiffs to operate a community residence or a recovery community on the Properties. Except as specifically provided in 3.0(b), this consideration is limited to the current intended use of the Properties as Group Residential Behavioral Health Treatment Facilities as defined herein, for the benefit of the current owners or operators, and shall not run with the Properties.

The City will issue the necessary license or licenses for 4609 North Peachtree Road, Dunwoody, Georgia, and 4484 North Shallowford Road, Dunwoody Georgia five days after the dismissal without prejudice of the Lawsuits. The City will issue the necessary license or licenses for 4821 North Peachtree Road, Dunwoody, Georgia five days after the later of the dismissal without prejudice of the Lawsuits or official notification from HUD that the HUD Complaint is resolved.

First draft of Dunwoody Comprehensive Plan would allow major changes by right, side stepping public vetting & Council review.

The required review of our Dunwoody Comprehensive Land Use Plan is on going and major changes are being proposed by Staff and the Steering Committee that would allow developers to make zoning changes like adding apartments & town homes in places they are currently not allowed and these development changes would not come in front of City Council for review as this latest document is proposing (with a future zoning rewrite) to allow this by right in specific places.    Below is a photo of just one of many zoning suggestions.

This is just the first draft but know that from my perspective this seems to be the push as City Staff wants to allow developers more freedom from the review and approval of the City Council.

  • There is a need for additional housing in both quantity and type, particularly for first-time buyers and seniors.
  • Residents would like to see a “Downtown Dunwoody” with walkable shops and restaurants.
  • Residents love local centers like Dunwoody Village and want to see these places to grow and thrive.
  • There is concern over vacant retail and office spaces impacting economic development & growth.
  • Traffic congestion is a major issue, and people want more connectivity and ways to get around.
  • People want to see their neighborhood character and greenspaces preserved.

Tuesday evening there will be a special called meeting of the Dunwoody City Council, actually it is a huge public meeting at Vintage Pizza on Chamblee Dunwoody Rd at 5:30 pm that will be taking place in order to inform the four zoning committees within the City of Dunwoody of the work of an ad-hock steering committee being led by staff direction and that of outside consultants.   As this is a City Council Meeting, there will be 30 mins of Public Comment time available at the start and end of the meeting but as it is taking place off site (away from City Hall), it does not look to be streamed or recorded as usual.

All four of the zoning committees in the meeting on Tuesday are either elected by the citizens or confirmed by City Council whereby the invited representatives in the audience will be the City Council, the Planning Commission, the Zoning Board of Appeals and the Development Authority.  These individuals as well as I am guessing the Comprehensive Plan Steering Committee are named down below.

The Comprehensive Land Use Plan is required to be updated by state law but this time around we are looking to also update our zoning code into a Unified Development Ordinance.  Based on the timelines previously presented I am guessing the first draft of the community agenda outlining the community vision, goals & policies will be presented soon if not on Tuesday. 

Right now redevelopment in the City of Dunwoody is thoughtful but slow with lots of eyes on every project whereby with a good presentation, quality data and appropriate community / neighbor backing; anything can get approved after it is properly vetted.   Slow is not a bad thing when the proposed development is immediately next door, or the change will allow a development to move forward which might change the character and feel of the community.  

I have not yet seen any proposed changes to the Comprehensive Land Use Plan and then the underlining Development Ordinance; but my concern is that it may be proposing land use changes by right, whereby a developer can do what he wants within the limits of the allowances, without the scrutiny of the public nor an approval of the Council.   I will be listening attentively during the meeting as this process and the proposed changes could have unintended consequences if not thoroughly reviewed prior to codification and approval.

Project Update: On Jan. 27, 2025, the project team presented an update to the Dunwoody City Council.

Recurring themes:

  •         There is a need for additional housing in both quantity and type, particularly for first-time buyers and seniors.
  •         Residents would like to see a “Downtown Dunwoody” with walkable shops and restaurants.
  •         Residents love local centers like Dunwoody Village and want to see these places to grow and thrive.
  •         There is concern over vacant retail and office spaces impacting economic development & growth.
  •         Traffic congestion is a major issue, and people want more connectivity and ways to get around.
  •         People want to see their neighborhood character and greenspaces preserved.

There were several special called meetings that took place in June while I was away on vacation that were called to have preliminary hearings on the setting the Millage Tax Rate for the City.   The tax rate is not changing as we are already at the maximum allowed per the charter but there was a 3% increase in the valuations therefore we need to advertise this as a tax increase.  Reminder that homeowners with an Homestead exemption and freeze in place, will not see a City of Dunwoody millage tax increase over last year.  Besides the millage rate item, the first special called meeting the evening of June 26th, had a few other items on the agenda I wanted to recognize.

First Read: Review and Consideration of a Text Amendment to Update the Clean Indoor Air Regulations, Chapter 24

I am not a smoker but I have attended "late night business meetings" in an establishment that focused on Bourbon and Cigars. The place of business I visited had a negative pressure air filtration system whereby my clothes didn't smell of smoke when I left.  I believe this proposed ordinance brought to us from the American Heart Association and placed on the agenda by staff or council is an overstep of regulations and I am unsure what we are fixing.  I would like to know the complete impact of the proposal prior to voting on it especially when it may limit a niche business model that could bring a successful establishment to our city.  I understand the intent of protecting all employees from second-hand smoke but when the establishment (or private club) can protect employees an exception needs to be explored.  I will be asking staff to review Gwinnett, Houston and other jurisdictions looking for best practices allowing exceptions.  A cigar bar exception could include the following ...

“Cigar Bar means an establishment operated by a holder of an On Premise Beer and Wine
Permit or other Alcohol Beverage Licensing Permit that:
1. Does not sell food;
2. In addition to selling beer and wine, annually receives 15 percent or more of
its gross revenue from the sale of cigars, and tobacco-related products, except from the sale of
cigarettes. A cigar bar shall not discount alcohol if sold in combination with
cigars or other tobacco products and tobacco-related products;
3. Has a walk-in humidor on the premises;
4. Has a high capacity, negative pressure air cleaning ventilation system, located in such a manner to control second hand smoke exposure to non-smokers.
5. Only permits the smoking of cigars, and does not permit the smoking of cigarettes; and
6. Does not include any establishment which is primarily a bar or restaurant and
which undertakes to make retail offerings of tobacco products as a means of
circumventing the purposes of this article.”

On November 7th, the Citizens of Dunwoody voted down a bond referendum for Parks & Paths development and on November 8th an RFP was released for the Winters Chapel Path design which mandates that the path will be 12 feet wide, even in front of the single family residential properties.  This item is now on the agenda for discussion.

Description: Winter Chapel Road Path Phase II. The project consists of a 12-foot shared-use path (SUP) along the west side only of Winters Chapel Road between Charmant Place and Peeler Road in the cities of Dunwoody and Peachtree Corners. In addition to the shared-use path, the project will add lighting and street trees along the corridor. The project connects residential areas on the north end of the project to a MARTA bus route and commercial node at the south end of the project.

City of Dunwoody to hold Joint City Council, Planning Commision and Development Authority session Tuesday Night - 6 p.m. (State of Perimeter Commercial Market 2023 & Edge City)

Tuesday evening at 6 p.m. there will be a rare Joint meeting of the Dunwoody City Council, the Dunwoody Planning Commission and the Dunwoody Development Authority to receive an update on the current state of the commercial market.  Yesterday in my blog post on the Monday Budget Committee Meeting, I posted an opinion from Colliers on the financial real estate health of the Central Perimeter Business District and I am guessing this Tuesday evening briefing will also bring forward more information.

I am also guessing that this meeting will count as training to assure that we are all following proper zoning practices to make our decisions.   The city has posted the agenda but no other documents for this meeting, that may change by Tuesday afternoon so please do check the City site in the agenda link below.
